Estate Distribution & Settlement

Distribution is where estates succeed or stall. The grant names who may act, but the heirs must still agree what each receives — shares calculated under the will or the applicable law, debts settled first, and every title moved through its own authority with its own file.

SRAG Wills guides families through lawful distribution of the estate — calculating each heir’s share, drafting sharing agreements where heirs rearrange the division by consent, and preparing the title transfers for property, vehicles, and accounts until every asset sits in its rightful hands.

Courts and departments decide and their schedules govern; our work is the calculation, the agreements, and the paperwork that lets the family close the file together.

How distribution moves forward

1

Shares calculated

We work out each heir's lawful share under the will or the applicable law, after debts and prior rights.

2

Agreement

Where heirs rearrange shares, we draft the sharing agreement and collect every signature.

3

Titles transferred

Each asset moves to its entitled heir — property, vehicles, accounts — with every authority's file closed.

Disclaimer: SRAG Wills is a wills consultancy, not a law firm or government body. Registration is completed with the DIFC Courts Wills Service or ADJD; estate and inheritance cases are filed with the Dubai Courts.

Frequently Asked Questions

In what order is an estate settled?

Debts first, distribution second. Funeral expenses, administration costs, the executor's entitlements, and the deceased's debts are settled ahead of division — under Dubai Law No. 15 of 2017 for DIFC-registered estates, and the applicable succession rules otherwise. Heirs receive what remains, not what the gross estate shows.

What is a sharing agreement among heirs?

Where the will — or the applicable law — leaves heirs holding shares they would rather rearrange, the heirs can agree in writing to divide differently: one keeps the apartment, another takes the accounts, a third is bought out. The agreement must be voluntary, signed by all heirs, and consistent with public order — we draft it in plain language so the court and each authority can act on it.

How are property titles transferred?

Against the court's grant and the distribution instrument, the Land Department transfers each title to the entitled heir — with its own forms, fees set by the department, and transfer procedures. Vehicles, shares, and accounts each have their own receiving office. We prepare each transfer file in the right order.

What if the heirs disagree?

Then the court decides, and distribution waits for the judgment. Our role is keeping disagreement from hardening — clear share calculations, written proposals, and documented agreements while consensus is still possible. Where consensus fails, the file goes to the court with the paperwork already in order.
